Many people love their Vitamix blenders because they can blend just about anything you want it them. However, when you buy a blender that costs hundreds of dollars, you don't want to have to worry about anything else ending up in your blended fruits and vegetables. There is a new lawsuit that is against the Vita-Mix Corporation. This class-action suit is claiming that the top of the seal on the blender's blade assembly on some of the blenders are defective. They will leave small black flecks of the nonstick material of the blender and get mixed in with your ingredients.
The lawsuit also claims that the company is guilty of being negligent in the blender's design as well as fraud and a breach of their contract. The Vita-Max company says they hired third party companies to test the flecks that were found and it was presumed that they are harmless if ingested. This as mentioned on a settlement website for the lawsuit. The company did not agree to admit fault. However, they have agreed to settle this lawsuit and offer compensation to customers who are not completely happy with the performance of their blender.
There are more than six million blenders that are eligible to receive this lawsuit compensation. The head of communication for Vita-Mix told Time Money that the company is not sure exactly how many of these blenders actually had the fleck problem. They honestly expect that the number of claimants for the settlement will be small.
Is Your Blender Eligible For The Vitamix Settlement?
If you are wanting to see if you can get part of the settlement for your Vitamix blender, you have come to the right place. You will be eligible to get a replacement part or a gift card if your blender falls into one of the following two categories. Check to see if you fall into either of these categories.
• When you inspect your Vitamix blender, check to see what the date is on your blade assembly. If your blender says that the assembly was made between January 1, 2007 and October 1, 2016, you will be able to get part of this settlement.
• Another way to see if you can be eligible for the lawsuit is to see if your commercial blender is one that came from a third-part dealer. To be eligible, it would need to have been bought from them between September 15, 2015 and August 9, 2016.
The dates can be easily found on both household and commercial blenders by looking for the date on top of one of the assembly's blades. These will be located at the bottom of your blender. When you find that you have a blender with a date that is eligible, you will also need to supply the 18-digit serial number of your specific blender. The Vitamix serial number will be found on the back of the blender or the bottom of the blender on the base of the motor.
When you decide to file a claim for one of the company's household blenders, you will be able to either choose to get a free replacement blade or a $70 gift card to be used on Vita-Mix products. The online Vitamix store sells everything from cookbooks and spatulas to cups and other accessories for your blending hobbies.
If you decide to choose the replacement blade part instead of the gift card, the company will send you a box with a prepaid shipping label to send your blender into the company to have the new blade installed. You will be able to expect your fixed blender to get back to you within 10 days after they initially receive it for repairs. If you don't get it within 10 days from them receiving it, you may contact the company for an explanation and possibly get yourself a gift card for having to wait too long to receive your repaired blender with the new blade.
For those who have the commercial version of the Vitamix blender, you are not able to choose the gift card option from the settlement. Owners of the commercial blenders are only able to get a replacement blade for their blenders. The settlement is currently waiting to get court approval on March 27th, 2018. In the meantime, you can file your claim now online.
